JOB DESCRIPTION SUMMARY
The HR Compliance Manager works to ensure Sunbelt Rentals maintains compliance with federal, state and local employment law, as well as various contract requirements as it pertains to HR functions. Likewise, the HR Compliance Manager partners with the field to ensure that team members maintain compliance with any post-employment obligations associated with Sunbelt Rentals' employment agreements. The HR Compliance Manager also assists with the development of Sunbelt Rentals Affirmative Action Plans and other compliance reporting.


Position Responsibilities:


Review contract requests and research compliance based on Sunbelt Rentals' policies and procedures as it pertains to HR functions (i.e. EEO, background checks, drug and alcohol testing, etc.)
Review third party employment agreements as necessary and assess eligibility for employment based on restrictions
Assist Talent/Recruiting Teams with reviewing restrictions for potential candidates
Act as point of contact for employment agreement enforcement matters and effectively and factually summarize these matters as they progress to keep relevant parties informed
Work with outside counsel in regards to the AAP and non-compete enforcement issues
Develop industry-leading job site compliance methods and procedures designed to ensure compliance with specific customer contract requirements as it pertains to EEO standards, background checks, drug & alcohol testing, etc., ensuring that doing business with Sunbelt Rentals is easy
Document measures taken in consideration of Sunbelt Rentals' Affirmative Action Plans, including issuing subcontractor notices, training needs, notable programs, accommodations, etc.
Prepare and compile data for the creation of Sunbelt Rentals' annual EEO, VEVRAA and Affirmative Action Plans
Ensure compliance with the requirements of Sunbelt's AAP, as well as other OFCCP or state-mandated measures including 16-step EEO program for construction concerns
Act as a subject matter expert in regards to Sunbelt Rentals' Employee Information Handbook and other employment policies and local, state and federal employment law
Partner with Legal and external resources in creating and maintaining a comprehensive state-by-state compliance guide which includes wage & hour, meal periods, pay structure and practices and provide daily guidance to HR and field associates
Identify policies and practices where Sunbelt Rentals could improve
Contribute to the creation of applicable training and communication materials as it relates to federal, state and local regulatory requirements, including HR forms such as job applications and position descriptions
Receive personalized training as a legal witness
Requirements:


Education & Experience:


Bachelor's Degree or equivalent experience plus 3-5 years creating and implementing AAPs for a large, national federal contractor, as well as experience with OFCCP audits and extensive knowledge of best practices as it pertains to AAP design and OFCCP compliance
Extensive knowledge of federal and state employment law
Ability to understand Sunbelt Rentals' culture and leverage that as a positive means of achieving objectives
Finds satisfaction in bringing consistency, but understands that exceptions will often outweigh the rule
Ability to multitask successfully
Strong follow-through skills and ability to resolve issues in a fast-paced environment
Ability to communicate effectively and provide the highest level of service across all levels of the organization
Excellent verbal and written communication and organizational skills
Maintain highly confidential employee information and files
Experience with Workday preferred
Physical Demands:
Must be able to bend, squat, crouch and/or reach and lift up to 25 pounds or more, as required by the job. Some Sunbelt jobs may require driving for long periods of time, loading and unloading heavy equipment, performing work in extreme weather conditions including rain, wind or excessive temperatures and/or night and weekend work. All duties must be performed according to Sunbelt's safety policies and guidelines. Reasonable accommodations may be made to comply with ADA/ADAAA.
